DEFINITIONS

"web sites(s)" means your Clients web site as provided by Weddings Web Design.
"we" and "us" means Weddings Web Design.
"you" and "your" means the person purchasing the license.
"client(s)" means your Customer.
"licence" means registering and making payment for one client

GENERAL TERMS AND CONDITIONS

• The Weddings Web Design offer is offered to you conditioned on your acceptance without modification of these Terms and Conditions. Your purchase of a Weddings Web Design licence constitutes your agreement to these Terms and Conditions.
• All content that is designed by Weddings Web Design and is used on the web sites will be Copyright of Weddings Web Design with the exception of customer-supplied artwork and information.
• You will allow us to place a small note stating 'design by John Graham Software' at the bottom of each page on the web site.  We reserve the right to change this note at any time.
• Weddings Web Design will host a web site site for you for a cost of £30.00 per licence for one calendar year from the client-specified activation date.
• All web sites hosted by us will have a limit of 500Mb of bandwidth per month. Any web site exceeding the quota will be charged at £1.00 per 1Mb per 24 hours.
• The web site cannot be hosted by any other organisation.
• The web site cannot link to any pages not hosted by Weddings Web Design.
• Any client updates must not be in contravention of the Terms and Conditions.
• We reserve the right to remove without notice or refund any web site that we deem unsuitable, for example (the list is not exhaustive):
  • Those that would violate any applicable law, regulation or third party right;
  • Those encouraging illegal activity or racism;
  • Those that promote or utilize software or services designed to deliver unsolicited e-mail;
  • Those advertising any materials, products and/or services related to pornography.
• Links to other web sites and/or pages of the internet is not permitted.
• Similar Terms and Conditions are applicable for your Client and can be viewed at www.the-special-day.co.uk. It is your responsibility to make your Client aware of them. You may be liable for any and all claims arising from your clients misuse of the web site.
  
  

• Weddings Web Design reserves the right to change the Terms and Conditions at anytime, effective upon making the modified provisions available on the Weddings Web Design web site. You are responsible for regularly reviewing these terms and conditions. Continued use of the Weddings Web Design offer after any such changes shall constitute your consent to such changes. Weddings Web Design does not and will not assume any obligation to notify you of any changes to the Terms and Conditions.
  

• As a condition of your use of the Weddings Web Design offer, you warrant to Weddings Web Design that you will not use the Weddings Web Design offer for any purpose that is unlawful, or prohibited by these Terms and Conditions (as the same may be modified from time to time). In addition, you may not link to the site any site containing an inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information, or material or information that violates any applicable intellectual property, proprietary, privacy or publicity rights.
  

• Weddings Web Design, The Special Day and John Graham Software shall have no liability for the accuracy of the information contained in the web site, or for delays or omissions therein. None of the foregoing parties shall be liable for any third party claims or losses of any nature, including, but not limited to, lost profits, punitive or consequential damages. Weddings Web Design reserves the right to remove any item in its database that is not deemed appropriate, or abuses the decency of Internet etiquette. Weddings Web Design, The Special Day and John Graham Software is not responsible for any losses or liabilities associated with the web site.
• You agree to defend, indemnify and hold Weddings Web Design, The Special Day and John Graham Software harmless from and against any and all claims, losses, liability costs and expenses (including but not limited to attorneys' fees) arising from your violation of these Terms and Conditions, or any third-party's rights, (including, without limitation, infringement of any copyright, violation of any proprietary right and invasion of any privacy rights). These obligations will survive any termination of your relationship with Weddings Web Design, The Special Day and John Graham Software.
